What is cruelty? How and why does it matter? What do the legal rejection of cruelty and the requirements of mercy entail? This essay asks these questions of Lucius Seneca, who first articulated an agent-based conception of cruelty in the context of punishment. The hypothesis is submitted that the answers to these questions offered in Seneca's De clementia constitute one of the turning points in the evolution of practical reason in law. I conclude, however, by arguing that even the mainstream (...) punitive practices of contemporary western societies fail to meet the modest imperatives of the rejection of cruelty and the unconditionality of mercy propounded by Seneca. This Article defines four distinct conceptions of cruelty found in underdeveloped form in domestic and international criminal law sources. The definition is analytical, focusing on the types of agency, victimization, causality, and values in each conception of cruelty. But no definition of cruelty will do justice to its object until complemented by the kind of understanding practical reason provides of the implications of the phenomenon of cruelty. -/- No one should be neutral in relation to cruelty. Eminently, cruelty in criminal (...) law, a human-created phenomenon, vigorously calls for responses in the form of preventive and corrective action on the part of private and public actors. It is in this sense that cruelty is a problem of practical reason, one of action preoccupied with its legal or moral obligations, rational grounds, value commitments, and actual consequences. -/- However, the connection between conceptions of cruelty and the implications practical reason can draw from the correct application of a conception of cruelty to phenomena in the world remains too detached to be able to capture and explain people's actual experiences both of seeing cruelty in the world and of confronting the question of what to do about cruelty and how to address its cultural and institutional aspects. Something is missing. -/- What is missing is the integration of conceptions of cruelty and the practical reason implications of detecting cruelty in the world into normative models which operate as meaning matrixes for cognition, meaning, and action. This Article undertakes this explanatory task through an exercise of reconstructing seminal philosophical ideas about cruelty. The result is that the four conceptions of cruelty are placed within three distinct normative models, which ultimately render intelligible legal conceptions of cruelty and legal reactions to it. The aim of this study was to analyze the association between physical activity and eating habits during the COVID-19 pandemic among Brazilian adults. A sample of 1,929 participants answered an online survey, however 1,874 were included in the analysis. The impact of the COVID-19 pandemic on eating habits was assessed inquiring about participants' intake of fruits, vegetables, fried foods, and sweets during the pandemic. Physical activity was assessed by asking participants about their weekly frequency, intensity and number of minutes/hours engaging (...) in structured physical activities per week. Participants were then stratified into categories based on moderate-to-vigorous intensity and into active or inactive. Increased sweets consumption was the most commonly reported change to eating habits, followed by an increase in the consumption of vegetables, fruits, and fried foods. Physical activity practice was related to lower consumption of fried foods and sweets. A cluster analysis revealed subjects with higher the level of physical activity was more likely to follow a healthy diet. Thus, physical activity was positively associated with healthier eating habits. Health authorities must recommend regular physical as a strategy to improve overall health during the COVID-19 pandemic. Future studies should address the physical activity interventions to improve health status during a pandemic. (shrink)

Responding to recent concerns about the reliability of the published literature in psychology and other disciplines, we formed the X-Phi Replicability Project to estimate the reproducibility of experimental philosophy. Drawing on a representative sample of 40 x-phi studies published between 2003 and 2015, we enlisted 20 research teams across 8 countries to conduct a high-quality replication of each study in order to compare the results to the original published findings. We found that x-phi studies – as represented in our sample (...) – successfully replicated about 70% of the time. We discuss possible reasons for this relatively high replication rate in the field of experimental philosophy and offer suggestions for best research practices going forward. (shrink)

Mucopolysaccharidosis type I (MPS I) is a rare lysosomal storage disorder treated with bone marrow transplantation or enzyme replacement therapy with laronidase, a high-cost orphan drug. Laronidase was approved by the US Food and Drug Administration and the European Medicines Agency in 2003 and by the Brazilian National Health Surveillance Agency in 2005. Many Brazilian MPS I patients have been receiving laronidase despite the absence of a governmental policy regulating access to the drug. Epidemiological and treatment data concerning MPS I (...) are scarce. This study aims to present a demographic profile of Brazilian patients with MPS I, describe the routes of access to laronidase in Brazil, and discuss associated ethical issues relating to public funding of orphan drugs. Essa solidariedade torna o estilo da obra um programa filosófico que responde a demandas precisas quanto ao papel das ciências da natureza, das ciências humanas e da técnica, sua classificação, sua história e sua consistência teórica, demandas que pretendemos especificar no artigo. Ao (...) mesmo tempo esse programa de Simondon requer que o autor recolha os princípios teóricos de sua análise em um corpo teórico cujas linhas gerais desenham a fisonomia de toda uma filosofia, de caráter peculiar. É isso o que justifica, e até mesmo exige, que Simondon tome por objeto o problema da individuação nos termos em que o faz, e que possa apresentar essa aproximação do problema como uma crítica cujo valor é ele mesmo filosófico: uma resposta peculiar ao positivismo, ao pragmatismo, ao estruturalismo e, sobretudo, às formas de compreensão das ciências e das técnicas que era hegemônica no final dos anos 50, no ambiente intelectual francês. abstract: There is a strict allegiance between the style present in L'Individuation à la Lumière des Notions de Forme et d'Information and the theoretical principles by which this work inquires the diverse individuation processes. That allegiance makes this style a whole investigation program on the role of natural sciences, humanities and technology in general, their classification, history and theoretical nature. The clauses of that investigation will be shown in its general lines by the paper itself. But the point is that, at the same time, this investigation program requires the specific theoretical principles adopted by Simondon in this work as a theory and in its development as a complete philosophy. Indeed this is the reason why Simondon takes the problem about individuation processes as the focus of his discussions. Such discussions offer a critique whose value is itself philosophical. That strategy results in a peculiar response to positivism, pragmatism, structuralism and the hegemonic way of thinking about sciences and techniques in the French fifties. (shrink)

Pretendemos, com esses princípios, sublinhara forma peculiar e original em que a filosofia de Simondon permite pensar a natureza do social e do político, semreduzir as ciências do espírito às ciências da natureza ou vice e versa.

Je me propose d'examiner les paragraphes 18 et 19 de la deuxième partie des Prolégomènes. Bien que ces deux paragraphes ne constituent pas l'intégralité de la déduction transcendantale des Prolégomènes, ils ont une fonction essentielle dans la mesure où ils exposent l’argument entier in nuce. Ces deux sections établissent de façon claire que la doctrine de l'idéalisme critique, présentée dans la première partie des Prolégomènes comme un idéalisme qui ne supprime pas « l'existence de la chose qui apparaît », joue (...) un rôle indispensable dans la déduction transcendantale, qui est présentée dans la deuxième partie à partir de la distinction entre jugement de perception et jugement d'expérience. BackgroundThe outbreak of novel coronavirus disease 2019 has caused a global panic and public concern due to its mortality ratio and lack of treatments/vaccines. Reduced levels of physical activity have been reported during the outbreak, affecting the normal daily pattern.ObjectiveTo investigate the relationship of physical activity level with sleep quality and the effects of reduction physical activity levels on sleep quality.MethodsA Google form was used to address personal information, COVID-19 personal care, physical activity, and mental health of 1,907 adult volunteers. Binary logistic regression was used to verify the association of physical activity parameters and sleep quality.ResultsInsufficient physical activity levels were a risk factor to have disturbed sleep pattern [OR: 1.28, 95% CI ]; however, when the BMI was added to the analysis, there was no more statistical difference [OR: 1.23, 95% CI ]. On the other hand, we found that the reduction of physical activity levels was associated with negative changes in sleep quality [OR: 1.73, 95% CI ], regardless all the confounders [OR: 1.30, 95% CI ], unless when feeling of depression was added in Model 6 [OR: 1.28, 95% CI ].ConclusionDisruption in daily physical activity routine, rather than physical activity level, negatively influences sleep quality during the COVID-19 quarantine. Background: This study developed a photo and video database of 4-to-6-year-olds expressing the seven induced and posed universal emotions and a neutral expression. Children participated in photo and video sessions designed to elicit the emotions, and the resulting images were further assessed by independent judges in two rounds. Methods: In the first round, two independent judges, experts in the Facial Action Coding System, firstly analysed 3,668 emotions facial expressions stimuli from 132 children. Both judges reached 100% agreement regarding 1,985 stimuli, (...) which were then selected for a second round of analysis between judges 3 and 4. Results: The result was 1,985 stimuli were produced from 124 participants. A Kappa index of 0.70 and an accuracy of 73% between experts were observed. Lower accuracy was found for emotional expression by 4-year-olds than 6-year-olds. Happiness, disgust and contempt had the highest agreement. After a sub-analysis evaluation of all four judges, 100% agreement was reached for 1,381 stimuli which compound the ChildEFES database with 124 participants and 51% induced photographs. The number of stimuli of each emotion were: 87 for neutrality, 363 for happiness, 170 for disgust, 104 for surprise, 152 for fear, 144 for sadness, 157 for anger 157, and 183 for contempt. Conclusions: The findings show that this photo and video database can facilitate research on the mechanisms involved in early childhood recognition of facial emotions in children, contributing to the understanding of facial emotion recognition deficits which characterise several neurodevelopmental and psychiatric disorders. Inicialmente, considera-se como as possibilidades de relações entre a psicanálise e a filosofia de Peirce têm sido objeto de trabalhos de filósofos e psicanalistas. São destacadas as noções de Winnicott sobre os objetos e fenômenos transicionais e o brincar, como uma área de particular interesse para o estudo dessas relações, dadas suas ligações com a filosofia de Peirce. É, então, indicado como Winnicott faz referência às relações da simbolização com os objetos e fenômenos transicionais e indica como um “full understanding” (...) dos processos de simbolização podem contribuir para o conhecimento desses fenômenos. Considerando essa manifestação de Winnicott, é examinado de que modo a semiótica de Peirce contém elementos que auxiliam o entendimento do que é chamado de “simbolização”, por Winnicott. Assim,, também permitindo a discriminação dos aspectos semióticos presentes nos objetos e fenômenos transicionais e no brincar, permitindo, assim, uma ampliação de algumas dimensões da significação das concepções de Winnicott. As questões referidas são examinadas amplamente nos casos clínicos de “Edmund” e “Diana”, citados por Winnicott e em outras duas situações clínicas apresentadas pelo autor. (shrink)

Le pari de cet ouvrage est d'explorer les facettes multiples à travers lesquelles se donne le soi. Parler de soi plutôt que de moi implique une rupture franche avec les philosophies qui placent le sujet humain en position fondatrice. Le soi est encore moins une « chose » mais un mode d'être ; le soi n'est pas une donnée mais une conquête dont le devenir est en partie indéterminé. C'est donc sous le signe des épreuves qu'il faut penser les variations (...) phénoménologiques et herméneutiques sur le soi. Si la philosophie reste la discipline dominante des réflexions qui parcourent les contributions du volume, l'originalité de cet ouvrage est d'offrir en même temps au lecteur d'autres variations par lesquelles se décline le soi. RESUMO:O objetivo de nossa exposição é mostrar que, em sua Carta a d’Alembert, Rousseau retoma o debate clássico sobre a relação entre o teatro e a moral nas mesmas bases estabelecidas por Platão. Sendo assim, a disputa sobre o teatro tem, da parte de Rousseau, uma objetividade que não encontramos no artigo de d’Alembert. Portanto, não se trata de uma diferença de opinião entre Rousseau e d’Alembert, mas da capacidade filosófica de bem compreender o que é próprio ao teatro e (...) à moralidade. ABSTRACTThe purpose of this article is to show how Rousseau, in his Letter to D’Alembert, takes up the classic debate between theatre and morals on the same grounds established by Plato. In Rousseau’s work, the debate about theatre has an objectivity that we do not find in D’Alembert’s article. Therefore, what is involved is not a difference of opinion between Rousseau and D’Alembert, but a difference in the philosophical ability to fully understand what concerns both theatre and morality. A recent paper by Jakl, Jung and Pultr succeeded for the first time in establishing a very natural link between bilattice logic and the duality theory of d-frames and bitopological spaces. In this paper we further exploit, extend and investigate this link from an algebraic and a logical point of view. In particular, we introduce classes of algebras that extend bilattices, d-frames and N4-lattices to a setting in which the negation is not necessarily involutive, and we study corresponding logics. Dans cette étude, nous cherchons à interroger et à creuser l’énigme du corps sensible en concevant l’affectivité comme la manière fondamentale d’être au monde dans la philosophie merleau-pontyenne. Notre étude vise à montrer que la chair agit comme l’«entre-deux» du corps sensible – que nous appelons le corps affectif-vécu (résonance affective-corporelle du monde en nous) – cristallisé dans la tonalité fondamentale de l’étonnement. Cette dimension affective de la pensée et de l’être constitue le fondement et le sens de toute l’expérience (...) du monde de la vie. Nous explorons l’affectivité en tant qu’intentionnalité non-objectivante, forme universelle de l’être brut et réhabilitation ontologique du sensible. Ce parcours nous mène du corps esthésiologique au corps libidinal, ouvrant à une autre compréhension du sentir, du désir, de l’amour et de la pensée. Nous étendons cette exploration du sensible aux domaines de l’art, de la littérature et de la théologie, envisageant les possibilités d’une autre métaphysique et d’une force anonyme au cœur du monde. Notre recherche met à jour des aspects impensés de la philosophie de Merleau-Ponty, suggérant une perspective renouvelée sur les catégories métaphysiques et, de cette manière, peut-être en révélant son propre impensé. À travers ce travail de réflexion, nous traçons le chemin d’un corps sensible pensant, en ressentant l’étonnement infini devant « l’étrangeté du monde et des choses » ainsi que devant l’énigme de notre propre incarnation.
